Trackzone terms and conditions

Applicability

These terms and conditions apply to all agreements, registrations, purchases and participation in Trackzone events.

Registration and formation of agreement

• Registration or purchase takes place through the Trackzone website.
• The agreement is formed after confirmation and full payment.
• Trackzone reserves the right to refuse a registration or order.

Prices and payment

• All stated prices include the legally applicable VAT. Depending on the event location, Dutch or foreign VAT may apply. The applicable VAT is shown separately on the invoice.
• Payment is made through the payment methods offered.
• Without full payment, participation or delivery is not guaranteed.

Participation requirements

The participant must be physically and mentally fit to participate and must have sufficient riding skill.

• An approved helmet is mandatory.
• A leather motorcycle suit or equivalent protective clothing is mandatory.
• Gloves and boots are mandatory.
• The participant must always follow instructions from Trackzone and circuit staff.

Safety and grouping

• Trackzone determines the group allocation.
• The allocation may be adjusted during the day.
• Decisions by the organisation are binding.
• Dangerous behaviour may lead to immediate exclusion.

Cancellation by participant

• Cancellation does not entitle the participant to a refund.
• The participant may transfer their place to someone else, provided Trackzone approves this in advance.
• Trackzone may charge administration costs.
• No-show does not entitle the participant to compensation.

Cancellation or change by Trackzone

Trackzone may change or cancel an event due to circumstances including weather conditions, safety reasons, force majeure or insufficient participants. In that case, Trackzone will offer a replacement date or credit in the form of a voucher. Refunds are excluded unless legally required.

Force majeure

Trackzone is not liable for force majeure situations.

• Extreme weather conditions
• Pandemics
• Government measures
• Circuit closures

Liability

• Participation is entirely at the participant's own risk.
• Trackzone is not liable for injury.
• Trackzone is not liable for damage to vehicles.
• Trackzone is not liable for loss or theft, except in case of intent or gross negligence by Trackzone.

Damage to circuit and third parties

The participant is fully liable for damage caused by them to the circuit, guardrails, airfences, infrastructure, other participants or third parties. All costs, including repair, transport and circuit downtime, are for the participant's account. Trackzone may charge these costs directly.

Insurance

The participant is responsible for appropriate insurance. Standard motorcycle insurance generally does not cover circuit use.

Code of conduct

• Respectful behaviour is mandatory.
• Reckless riding is prohibited.
• Alcohol or drug use is prohibited.
• Violation may lead to exclusion without refund.

Exclusion of withdrawal right for events

The right of withdrawal does not apply to events under article 6:230p of the Dutch Civil Code. By purchasing a ticket, the participant agrees to this.

Applicability webshop

This part applies to all purchases of products through the webshop.

Offer

• Offers are non-binding.
• Obvious errors do not bind Trackzone.

Delivery

• Delivery times are indicative.
• Delay does not entitle the customer to compensation.
• Risk transfers upon delivery to the customer.

Right of withdrawal

• The customer has the right to return a product within 14 days after receipt.
• After notification, the customer has 14 days to return the product.
• The product must be unused and in its original condition.
• Return costs are for the customer's account.
• Refunds are made within 14 days after receipt.

Exceptions to withdrawal right

There is no right of withdrawal for personalised products, hygiene products where the seal has been broken, digital products, events and tickets.

Warranty and complaints

• Products comply with the agreement.
• Statutory warranty applies.
• Complaints must be reported in time.

Webshop liability

• Trackzone is not liable for indirect damage.
• Liability is limited to the purchase amount.

Retention of ownership

Products remain the property of Trackzone until full payment has been made.

Intellectual property

• All rights belong to Trackzone.
• Event imagery may be used for promotional purposes.

Privacy

Personal data is processed according to Trackzone's privacy policy.

Changes

Trackzone may change these terms. The most recent version applies.

Applicable law and disputes

• Dutch law applies.
• Disputes will be submitted to the competent court in the Netherlands.
